 1. Purchasing

1.1. We always advise our customers to obtain a sample of their chosen fabric, paint, wallpaper, flooring or trimmings to ensure that you are 100% happy with the item before ordering. Marsh & Co. cannot be held responsible for any customers choice of material once ordered. Please bear in mind that colours can change in different lights and at different times of the day.

1.2. We kindly ask that prior to ordering please ensure the suitability of the product for your chosen purpose or use.  We are unable to accept any liability arising in respect of any loss, damage, size or deterioration in condition of any goods sold caused by usage, shrinkage, cleaning processes, atmospheric conditions or assembly, make-up, installation or general application. Marsh & Co. cannot be held responsible for any third party tradesmen.

Fabrics to be used for Upholstery need to comply with the Furniture and Furnishing Fire Safety regulations which came into effect in 1988. If they do not meet regulations, your Upholsterer may be able to use an Interliner or Barrier cloth - please check with your Upholsterer before ordering.

1.3. From time to time items may be out of stock with our suppliers. If for any reason your order cannot be fulfilled due to our suppliers stock levels we will contact you at the ealiest opportunity after receiving your order. If your purchase is out of stock we will advise you with an anticipated delivery date. If this new delivery date does not satisfy your requirements we will issue a full refund on the card supplied at check out. For customers prepared to wait for out of stock items payment will still be taken at checkout and held. We cannot be responsible for delays beyond our control, and will not be responsible for compensating you for any consequential loss, which you may suffer if we do not supply goods in the originally anticipated time-scales. Anticipated delivery dates can often change and although we will always do our utmost to advise you immediately of any changes, anticipated delivery dates are not always communicated to us by our suppliers straight away.

1.4. The minimum order is usually one metre of fabric or one roll of wallpaper, unless the fabric / wallpaper company impose different quantities. Thereafter, you can order fabric in 10 cm increments.

1.5. No goods can be released to clients until payment has been received in full.

1.6. No orders shall be accepted from persons under the age of 16.

1.7. All products displayed on this website are subject to availability.

1.8. No statement on this website shall be deemed to affect the statutory rights of a consumer which cannot be  excluded or restricted by Law.

1.9. All prices displayed on our website are inclusive of VAT at the current rate of 20%. Prices do not include delivery charges unless otherwise started.


2. Samples

2.1 Fabric, wallpaper and trimming samples and paint colour swatches will be sent by post. Please allow up to 10 working days to receive samples as we may often need to order these from our suppliers first. Marsh & Co. will post out part orders if there is a delay with any sample(s) and post remaining samples when they come available.  Although we do our utmost to ensure that our images are a close representation of our products, screen colours can differ from monitor to monitor and may often not be a true representation of the product. Shades and colours can sometimes vary slightly between samples and batches, so if the colour match is critical, please call us and ask us to order you a 'stock cutting' of the current batch when placing your order.

2.2 Samples can vary in size. Often a small A5 cutting will be sent out to you but sizes can vary between suppliers. Larger returnable samples are available from some suppliers. For larger returnable samples please call us on 07788 131934 These are priced on application, the cost of these less 25% administration will be refunded providing they are returned within 20 days.


3. Delivery

3.1 All delivery charges are quoted at checkout. For small items we use 'Royal Mail First Class Recorded' or 'Special Delivery'. For larger orders, mainland UK delivery is normally by next day carrier. This will usually be Parcelforce or UPS.  Delivery charges apply to UK mainland only. If you require delivery to an address outside the UK mainland and Northern Ireland, please contact us before placing your order. For deliveries outside the UK mainland we will contact you immediately to advise of any additional charges. If you do not approve any additional delivery charges we will issue you with a full refund.

3.2 Orders can only be sent to one address. If you require that part of your order be sent to a different address, please order those items separately.

3.3 Approximate delivery times to the UK mainland are quoted within the product information but please allow up to 14 working days for delivery as items are usually ordered direct from our suppliers. We would normally expect your order to be dispatched to you within 5 to 10 working days. If you are working to a deadline, Saturday deliveries and 'before 9:30am' or 'before 12 noon' services can be provided at additional cost, please let us know when placing your order. Often express deliveries can be arranged for an additional fee. Some suppliers hold their main stock outside of the UK and so some orders may on occasion take slightly longer than this. For delivery times to addresses off the UK mainland and Northern Irleand, please contact us before placing your order.

Marsh & Co. cannot be held responsible for delayed deliveries caused our courier networks or adverse weather conditions.

3.5 Products dispatched from Marsh & Co. or directly from the suppliers are typically sent by courier. In both cases, a signature will be required to take delivery of your goods.

IMPORTANT - Please check all packaging for damage upon delivery. Damaged parcels must be signed for as damaged. Any damage that has ocurred in transit that has been signed for as 'received in good condition' cannot be compensated.

6. Returns / Cancellations

Made to measure items

Unfortunately Marsh & Co. cannot accept returns on any made to measure products including hand made curtains, blinds, upholstery, tracks and poles. If for any reason there are faults with our products or any damage has been caused during installation these must be reported to Marsh & Co. with 48 hours. We regret that we cannot except returns on made to measure items unless they are deemed faulty. Although we will advise you where necessary, Marsh & Co. cannot be held responsible for any choice of fabric, materials or design. 

Fabrics

As your fabric order has been cut to order we do not accept returns on fabrics. In some cases on orders over 5 meters we will accept returns but this could incur a handling fee of up to 50% off the value of the order. This will depend on the supplier.

Please bear in mind that all fabrics will eventually fade. To reduce natural fading we recommend the use of a good quality lining. Fabrics / leather should be kept out of natural sunlight. Certain fabrics like silk are more prone to fading than others. All our fabrics are rigorously checked for defects. It is the responsibility of the customer to ensure that the correct cleaning method is used. Marsh & Co. cannot be held responsible for any damage caused by cleaning. Marsh & Co. cannot be held responsible for any damage caused by third parties. For rug / carpet orders please be aware the rug may lose initial fibres and should be vacuumed regularly.

Non made to measure items

For wallpaper, Marsh & Co. will only accept complete orders, we do not allow returns on part orders. We do not allow returns on paint orders.

All other items such as rugs, cushions, lighting may be returned within 14 days of delivery. Items must be returned undamaged and in their original packaging. To return an item we must be notified withing 14 days of delivery. For a full refund goods must be sent back within 14 working days of Marsh & Co. being notified of the return. Delivery charges are non refundable on all returns and it is the customers responsibility to pay to return their order. Please note that on larger items such as furniture and sideboard we subsidise our delivery costs so the cost to return your items maybe more than the price originally quote.

Please inspect your items when you receive them. For fabrics and wallpapers, please check you are happy prior to cutting or hanging. If your order arrives damaged or faulty please let us know within 48 hours of delivery.

Marsh & Co. cannot be held responsible for goods that have been damaged in transit once the goods have been signed for. Please check all items before signing for them


7. Receipt of goods

Please check all items before signing for them, If a friend or neighbor is signing for the goods we would advise that you ask them to check all the goods for damage before signing for delivery. For fabric & wallpaper orders, please check for faults or defects before cutting. Please check that the fabric/wallpaper is the correct width and if you already have a sample please check the fabric/wallpaper is the correct colour. Please check that the fabric/wallpaper code and quantity match your order confirmation. Marsh & Co. cannot be held responsible for any miss measures. For items that require fitting e.g. curtain poles, we recommend that you employ specialist installers. Marsh & Co. Interiors cannot take responsibility for third party contractors. 


8. Website content & Product Information

At Marsh & Co. we take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was uploaded onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our Order acceptance policy. Please note that in the event that an error is identified non-acceptance of an order by us may occur, subject to your statutory rights.

We are reliant upon receiving timely information from our Suppliers, and cannot be held responsible for any inaccuracies. Please check the product information prior to ordering, as this is being constantly updated and amended.

We cannot be held responsible for pricing, typographical, or other errors on our website.


9. Amendments to these Terms & Conditions

We reserve the right to amend these terms and conditions at any time. Any such amendments will take effect when posted on the Website and it is your responsibility to read the terms and conditions on each occasion you use our website and your continued use of the Marsh & Co. website shall signify your acceptance to be bound by the latest terms and conditions.


10. Intellectual Property

You recognise and agree that all copyright, database rights, trademarks and all other intellectual property rights in all material and/or content of this Website is owned by Marsh & Co. or our licensors and shall remain at all times vested in us or our licensors as expressly authorized by us or our licensors.


11. Risk and Title

All title, ownership and risk to the ordered Products will pass to you when they have been delivered to you. Once the Products have been delivered to you they will be held at your own risk and we will not be liable for them.


12. Entire Agreement

You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these terms and conditions and you agree that you shall have no remedy in respect of any representation.


13. Severance

If any provision contained in these terms and conditions is considered by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other terms and conditions which shall remain in full force and effect.



14. Assignment

You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party without our written consent. We reserve the right to transfer, assign, novate or subcontract any of our rights or obligations under these terms and conditions or any related contract to any third party.


15. Waiver

A failure by us to exercise or enforce any right conferred upon us by these terms and conditions shall not be deemed to be a waiver of such right or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.


16. General

The laws of England and Wales govern these Conditions and all disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
